Who Repairs A Damaged Apartment? Landlord or Tenant?

Can somebody enlighten me on this.  Whose  responsibility is it to carry out repairs on a house you are have been given quit notice, taking into consideration that some damages are natural and some are man made. Pls I need advice

At impulse the landlord will have to be the one to bare the repairs for one major reason in Nigeria, most houses are built with substandard materials and before you pack in some of these buildings are already developing problems, so I think what should be done and also be included on agreement is that a liability time of 3months should be given to the landlord as any parts of the building that may be damaged during this period should be repaired by the landlord. Contractors of big time projects do it for their clients (6months) so why not landlords.

na wa o!if ur pikin break the glass for door,will you wait for the landlord to come repair it for you?Anyways,it all depends on the agreement made before you parked in.But don't expect the landlord to do EVERYTHING for you.

When I used to leave in Lagos, the Landlolrd did nt take responsibilty for any repairs in the house, the tenants fixed everything within their flats, no more no less.

The Landlords in these part of the world are not responsive.

in nigeria before packing into a house you pay all sorts of agreement which includes in nigeria parlance damages fee. what happens to the fee if a tenant leaves the house in good condition.most cases landlords dont return such fees.in your agreement dovent didnt you pay damages fee.i think that should cover for damages made during your stay

It is the duty of the Landlord to repair any damage thing in his house not the tenant.

I dont know how its done in naija but here you have to pay a security deposit before you move in. Usually minor repairs while you are a tenant are to be fixed by the landlord. Your security deposit will be returned to you if at the end of your stay only if you leave the apartment in good condition. Normal depreciation is acceptable you dont get charged for that. If you thrash the apartment, let your kids scrawl all over the walls, let your pets poop on the carperts and leave heavy unsightly stains , you best believe that your security deposit is going towards those repairs. You may also have o cough up more if you really tore the place up.

To add to what Lawyer said, as a tenant it's important to take stock of the condition a rental apartment is in and give the Lanlord the condition document to sign before you move in.

Tenant's responsibilities

*

Pay the rent on time. Must be paid by midnight on the ninth day after the day it is due, or the landlord may start legal proceedings to evict the tenant.

*

Keep the apartment and the surrounding area clean and in good condition.

*

Keep noise to a level that will not disturb your neighbors.

*

Repair any damage occurring to the apartment through the fault of the tenant, family members or guests. Notify landlord at once of major damage.

*

Give the landlord permission to enter the apartment at reasonable times and with advance notice to inspect it or to make any necessary repairs.

*

Notify the landlord of any anticipated prolonged absence from the apartment so he or she can keep an eye on things.

*

When moving out, give landlord proper advance notice. Be sure that the apartment is in the same condition as when the tenant moved in and return the key to the landlord promptly.

*

Notify the landlord immediately if the apartment needs repair through no fault of the tenant.

*

Landlord's responsibilities/Tenant's rights:

*

A clean apartment when the tenant moves in;

*

Clean common areas (hallways, stairs, yards, entryways);

*

Well lit hallways and entryways; and,

*

Properly working plumbing and heating (both hot and cold running water).

if a landlord fails to make repairs after a tenant notifies the landlord about the need for repairs, the tenant has several options. A tenant may call a housing inspector at the D.C. Rental Accommodations Office who will report the violations to the landlord and the Department of Consumer and Regulatory Affairs.

Serious repair issues, such as faulty electrical wiring, gas leaks, and structural damage may be violations of the local building code which should be brought to the attention of the Building Inspection office for your city or county. The Building Inspector may inspect your building, and if warranted, issue a citation to the landlord for any violations that require repairs.

na wa for una if na say u be landlord u go make that kind post kai the people well it all depends on the agreement you have or didnt you sign any agreement before taaking the house if you did then no need to ask questions its usually stated there

I know for certain it is wrong for u to pay for a meter if it wasnt placed specifically in ur care. If it was in public domain then he should have thot about that before he place it there. As for the stuffs u fix. U should have had a kind of written agreement of everything and even pictures before u moved in, most people have camera phone but dont know what to do wit it. This where a camera phone could have been put to use. Dont let him intimidate u.

Thank you for your advice lawyer, let me just give you the picture of the whole issue. The agent gave everybody in the house quit notice just because we all failed to attend a meeting he scheduled for one saturday. May be other tenant will go and talk to him later but I was not ready because I was getting tired of the house already. I called the agent and the landlord if they will be willing to return my balance if am packing out immediately, and they said yes. I have spent 4 months and I have about 120k to get as my balance. Many of those things used in the finishing of the house were of inferior qualities. It is a new house though, but somethings were spoilt before we packing and he was aware of it like some door handles. The plumbering is another issue. I have spent so much on putting the plumbering into place when I packed in newly. I told the agent and the landlord but he said since I have taken possesion I have to be responsible. Some I was able to achieved some I could not. The man wants to take advantage of my balance with him. He wants me to put the whole apartment into the new form and I think landlord are expected to carry out some repairs on his own or a joint effort of tenant and landlord, i stand to be corrected pls. The major repair is the plumbering and repairs in the kitchen cabinent. Also, thief came to our house sometimes in August and went away with two meter (PHCN) including the one am using. The man said I will have to pay for it. The meter is placed in the steer case everybody is using. what should I do, I need my money badly. Thanks.

i would think if it wasn't addressed before you moved in, the burden of proof to show those damages wasn't done during your tenancy falls squarely on you. As already stated by the lawyer earlier, it depends on what you signed.

This is why it is very important for you to have a tenancy agreement reviewed by your lawyer before you pay money to get an apartment.

Generally a tenancy agreement stipulates various duties that both the landlord and tenant should carry out during the tenancy period. These duties are called Covenants and it outlines which duties you should carry out and those of the landlord in respect of maintaining the structures in the apartment and its surrounding and effectively stipulates who is liable when there is a conflict.

From your question, it is evident that you have been given a quit notice and the quit notice still makes you a tenant till your tenancy expires. Your allusion to ertain damages that are natural and some man made, does follow. If you intentionally destroyed the door in your apartment during the tenacy period, it is your duty to repair it even though your given a quit notice unless the landlord can sue you for repairs even after the tenacy expires and if the roof is leaking, it is the duty of the landlord to repair it if it has been caused by natural causes.

You have to be specific to tell me what the real issue is in respect of repairs that you are talking about for me to know who actually carries the burden of responsibility to carry out that repair.

If you dont have a tenancy agreement, the law squarely puts it in the hands of the tenant to carry out that repair except it can be inferred that a landlord is the one in charge of it.
